By using this website, you agree to be bound by these Disclaimers, and Terms and Conditions of Use (together, the “Terms of Service”). These Terms of Service govern your use of our website; if you disagree with any part of the Terms of Service, do not use our website.  

These Terms of Service refer to the following additional terms, which also apply to your use of our website:

  • Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. The Privacy Policy can be found on our Privacy Policy page.
  • Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of our website. When using our website, you must comply with the Acceptable Use Policy, which can be found below.

We reserve the right to change these Terms of Service or to impose new conditions on use of the website, from time to time, in which case we will post the revised Terms of Service on this website.  By continuing to use the website after we post any such changes, you accept the Terms of Service, as modified, whether or not you have reviewed them.  You should therefore check periodically for changes.

Terms of Use: Member License

Purchase of a membership entitles the member the right to reproduce the pages for a single classroom use only. Duplication for another teacher, grade level team, an entire school, an entire school system or commercial purposes is strictly forbidden without prior written permission from the Clever School Teacher (Except that a substitute teacher in your classroom may use the purchased materials while teaching in your classroom.)  Additional user memberships are available for purchase through Cleverschoolteacher.com; one additional license per additional user must be purchased. Only by purchasing additional user licenses may multiple teachers share this product.

Intellectual Property Rights

All rights reserved. No part of this website or the publications available on this website, may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without our prior written permission, except in the case of brief quotations embodied in critical reviews and certain other noncommercial uses permitted by copyright law.

This website and all the materials available on the website are the property of the Company and/or our affiliates, and are protected by copyright, trademark, and other intellectual property laws. You may not use the website or the materials available on the website in a manner that constitutes an infringement of our rights or that has not been authorized by us.  More specifically, unless explicitly authorized in these Terms of Service, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the website.

Digital Millennium Copyright Act (DMCA)

Just as we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe content located on or linked to by our website violates your copyright, you are encouraged to notify us. Children’s Online Privacy Protection Rule (COPPA)

We comply with the requirements of the federal Children’s Online Privacy Protection Rule (COPPA).  We do not specifically market to children under the age of 13; our website is directed to people who are at least 13 years old or older.  We do not knowingly collect any information from anyone under the age of 13. Our memberships are intended for teachers, homeschool educators and other adults; students do not need, and should not create, their own accounts. If we learn that we have collected personal information from a child under 13, we will delete it promptly. If you believe a child has provided us with personal information, please contact us at support@cleverschoolteacher.com.

Your Account

To access member resources you need an account. You agree to give us accurate information, to keep your password private, and to let us know right away if you think someone else has used your account. Accounts are personal: each account is for one teacher, and you may not share your login with anyone else. You are responsible for activity that happens under your account.

Memberships, Billing and Free Trials

Membership plans, prices and what each plan includes are described on our pricing page. Payments are processed securely by our payment provider, Stripe; we do not store your full card details.

  • Monthly memberships are charged when you sign up and then on the 1st of every month until you cancel. Your first payment covers the rest of the month in which you join.
  • Yearly memberships are charged once when you sign up and renew automatically one year later unless you cancel.
  • Free trials give you access to your chosen plan with no charge until the 1st of the following month. If you do not cancel before then, your membership continues and your card is charged the plan price on that date and every month after.
  • Memberships renew automatically. By signing up you authorize us to charge your payment method for each renewal until you cancel.
  • If a payment fails, we may retry it and your access may be paused until payment is made.
  • We may change our prices from time to time. Any price change will apply from your next renewal after we have given you notice, and you can cancel before it takes effect.

Cancellation and Refunds

You can cancel at any time from My Account. When you cancel, you will not be charged again and you keep access until the end of the period you have already paid for. After that, you will no longer be able to download resources, so please save anything you want to keep.

Because you have immediate access to downloadable resources, payments are non-refundable, including for partial months or partial years, except where a refund is required by law. If you believe you were charged in error, please contact us at support@cleverschoolteacher.com and we will look into it.

School and Group Licenses

Schools, districts and other organizations may purchase licenses for multiple teachers. Each license (seat) is for one named teacher, who receives their own account. A school administrator or group manager may add or remove teachers up to the number of seats purchased. Materials may only be used by the licensed teachers, each in their own classroom. Group pricing and terms are agreed in writing through our schools page.

Access Codes and Promotions

Access codes, discount codes and promotional offers are subject to the terms stated when they are issued, including any expiry date and limit on the number of uses. Unless stated otherwise, codes may be redeemed once per person, cannot be exchanged for cash, and may not be sold or published. We may cancel codes that are obtained or used improperly.

Acceptable Use Policy

You may use the website and the materials for your own teaching: to browse, preview, download, print and copy pages for the students in your own classroom, and to share printed copies with your students and their families for learning at home.

You may not:

  • share your login, or give or send downloaded files to other teachers, grade-level teams, schools or districts (unless each teacher has their own membership or license);
  • upload materials, in whole or in part, to any website, shared drive, learning platform or social media where people other than your own students can access them;
  • sell, resell, sublicense or redistribute materials, or include them in products or services of your own, whether free or paid;
  • remove or alter copyright notices, branding or credits on any material;
  • use automated tools to download, copy or scrape the website or its materials, or use the materials to train or build artificial intelligence or machine-learning models;
  • try to get around our security, access controls or download limits, or access accounts or areas of the website you are not entitled to;
  • use the website in any way that is unlawful, harmful, abusive or that interferes with other users or with the website's operation.

Changes to the Website and Materials

We add new resources regularly and may update, replace or remove materials, features or plans at any time. We try to keep the website available and working, but we cannot guarantee that it will always be available or free of errors.

Third-Party Services

The website uses third-party services, for example to process payments and send email, and may link to other websites. We are not responsible for the content or practices of third-party websites or services.

Disclaimer

Our materials are provided for educational purposes and are intended to support, not replace, your professional judgment as a teacher. Please review materials before using them with your students and adapt them to your students' needs and your school's policies. The website and materials are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Clever School Teacher will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of the website or materials. Our total liability to you for any claim relating to the website or your membership will not exceed the amount you paid us in the twelve months before the claim arose. Nothing in these Terms of Service limits any rights you have that cannot be limited by law.

Suspension and Termination

We may suspend or close an account that breaks these Terms of Service, including the Member License and the Acceptable Use Policy, or that is used for fraud or abuse. Where we close an account for these reasons, no refund will be given. You may stop using the website and cancel your membership at any time.
